1. ABOUT THIS POLICY
This Privacy Policy (Policy) describes how Metrics Business Finance Pty Ltd (ABN 44 603 289 658), MBF SME Lending Pty Ltd (ABN 93 658 177 989) and MBF Leasing Pty Ltd (ABN 14 654 845 182) and its related entities (“MBF”, “we”, “our” or “us”) collects, handles and protects the privacy of your personal information.
By using our websites, applications and services, or otherwise providing us with your information, you consent to us collecting, holding, using and disclosing your personal information as described in this Policy. If we are not able to collect, handle, use and disclose personal information about you as set out in this Policy, we may not be able to provide you with our services or with access to our websites or applications.
MBF is a non-bank financier and collects personal information in the course of providing consumer credit services.
We are committed to protecting your privacy and understand the importance of protecting your personal information. This Policy outlines the types of personal information that we usually collect about you, the purposes for which we collect it, to whom we disclose it, how we hold and keep it secure and your rights in relation to your personal information, including how to complain and how we deal with complaints.
We will handle your personal information in accordance with this Policy, legislation including the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).
In this Policy, personal information means any information or opinion about an identified individual or an individual who is reasonably identifiable, whether true or not. It does not include information that is de-identified (anonymous data). Sensitive information is a subset of personal information that is generally afforded a higher level of protection by privacy laws. It includes your health information as well as information about your racial or ethnic origin, political opinions, membership of political, professional or trade associations or trade unions, religious beliefs, sexual orientation or practices and criminal record.
This Policy does not apply to the personal information of our employees.
We may amend and update this Privacy Policy from time to time. Any changes will be published on our website at www.metricsbusinessfinance.com.au and effective at the time of publication.
2. TYPES OF PERSONAL INFORMATION WE COLLECT
MBF collects personal information from our customers (existing and potential) and their personnel and guarantors, business associates, about visitors to our website, as well as from contractors, job applicants and third parties with whom we deal, such as service providers and brokers. The types of personal information we collect depends on your dealings with us and includes:
- name, date of birth, address, email address and phone number;
- identification documents or verification information (electronic or otherwise), such as a passport and drivers’ licence;
- occupation;
- bank account details; and
- financial information (if expressly authorised) including:
- credit reports from credit reporting bodies;
- your credit application history with us and other credit providers, including the type and amount of credit you have applied for, the start and end date of that credit;
- repayment history information, including whether you owe any payments to us or another credit provider that are overdue;
- credit ratings, scores and evaluations about you and your credit worthiness;
- Information about any judgment of an Australian court that has been made against you and relates to credit that was provided to, or applied for, by you, including whether you have been declared bankrupt or have been subject to insolvency;
- whether we have accessed your credit information previously;
- information about any payments owed by you as a borrower or guarantor in connection with consumer credit that remains overdue for more than sixty (60) days;
- payment information about you including whether any overdue payments have been paid;
- information recorded in the National Personal Insolvency Index relating to your bankruptcy, a debt agreement proposal given by you, a debt agreement made by you, a personal insolvency agreement executed by you, a direction given, or an order made, under the Bankruptcy Act that relates to your property or an authority signed under the Bankruptcy Act that relates to your property;
- publicly available information about you that relates to your activities in Australia and your credit worthiness, and that is not court proceedings information about you.

In some cases, with your consent, we may also collect ‘sensitive information’, such as information about an individual’s membership of a professional association, criminal record or health information.
If you apply for a job or contract position with us, we may also collect the following types of information, including sensitive information, about you:
- employment history and qualifications;
- academic records;
- references;
- criminal history record;
- directorships; and
- eligibility to work in Australia.
3. DEALING WITH US ANONYMOUSLY OR USING A PSEUDONYM
Where possible and lawful, you may interact with us anonymously or using a pseudonym. For example, if you contact us directly with a general question we will not record your name unless we need it to adequately handle your question.
However, for many of our functions and activities we and our partners usually need your name, contact information and other details to enable us to provide our services or products to you.
4. WAYS WE COLLECT YOUR PERSONAL INFORMATION
We generally collect personal information from you directly or indirectly when you interact with us (e.g., via your interactions with our website, over the phone, via email, forms, questionnaires or in person). We may also receive personal information from a third party such as a broker or credit reporting bodies (CRBs) and publicly available sources (such as public registers).
If we are provided with personal information about you from a third party, we will take reasonable steps to ensure that you are or have been made aware of the matters set out in this Privacy Policy. You may also appoint us as your agent to obtain credit information about you from a credit reporting body or credit provider, to assist us in providing services to you.
If you apply for a job or contract position with us, we may also collect personal information about you from third parties and publicly available sources, including:
- government departments to verify your entitlement to work in Australia;
- the police to obtain your criminal history record;
- academic institutions and professional bodies;
- your current or previous employers; or
- your referees.

If we do not collect your personal information and credit information, we may decline to provide commercial credit to you or an organisation or entity you are involved with.
5. PURPOSES FOR WHICH WE COLLECT PERSONAL INFORMATION
We collect, use and disclose your personal information (including credit information) for the following purposes:
- to assess your application for any product;
- to help us provide our products and services to you and to administer, monitor and evaluate those products and services,
- to undertake research, planning, product development, risk assessment, risk modelling and marketing;
- to help us improve the products and services offered to our clients, and to enhance our overall business;
- to protect our business and other clients from fraud or unlawful activity, including undertaking identity verification (know your customer) checks;
- conduct or allow others to conduct direct marketing;
- communicating with you in various ways;
- the general management and conduct of our business;
- complying with our legal obligations, resolving any disputes and enforcing our agreements and rights with third parties;
- considering your employment application;
- to conduct our business and perform other management and administration tasks;
- to assist you with your queries and consider and evaluate any concerns or complaints you may have.
6. DISCLOSING YOUR PERSONAL INFORMATION
In the course of conducting our business, we may disclose your personal information (including credit information) to a related body corporate, an agent, contractor or service provider we engage to carry out our functions and activities, such as our lawyers, accountants, debt collectors or other advisors, organisations involved in a transfer or sale of all or part of our assets or business, organisations involved in managing payments, including payment merchants and other financial institutions such as banks, regulatory bodies, government agencies, law enforcement bodies and courts, financial product issuers and credit providers, and anyone else to whom the individual authorises us to disclose it or is required by law.
We will not send personal information to recipients outside of Australia unless:
- we have taken reasonable steps to ensure that the recipient does not breach the Act, the Australian Privacy Principles and the Privacy (Credit Reporting) Code 2014;
- the recipient is subject to an information privacy scheme similar to the Privacy Act; or
- you consent to the disclosure.
We may disclose your personal information to our service providers that are based overseas.
7. SECURITY AND STORAGE
We store your personal information in hard copy and electronically. Electronic information may be stored with a third party storage provider in Australia or elsewhere and may be combined or linked to other information held about you in a client file. Service providers with whom we share personal information are bound by obligations of confidentiality. We take all reasonable and appropriate steps (including organisational and technological measures such as encryption) to protect your personal information (including credit information) from misuse, interference and loss, as well as unauthorised access, modification or disclosure. Computer stored information is protected through the use of passwords, and we limit access to your personal information to those staff members and third parties who need to know, in order to conduct our business, and service your account.
8. ACCESS TO AND CORRECTION OF YOUR INFORMATION
We only keep your personal information for as long as it is required for the purpose for which it was collected or as otherwise required by applicable laws. If we no longer need to hold your personal information for any reason or we are no longer required by law to keep it, we will take reasonable steps to de-identify or destroy that information. These steps may vary depending on the nature of the information, the way it was collected and how it was stored.
We aim to ensure that the personal information collected from you is up to date, accurate and complete. You may request access to and correction of the personal information we hold about you at any time by contacting us. We will need to verify your identity before we provide you access to your personal information, and that you clearly specify the personal information you want access to. Subject to any applicable exceptions or requirements, we will provide you with access to the personal information you request within reasonable time and usually within 28 days. If we decide to refuse your access or correction request, we will provide our reasons in writing and explain how to complain.
9. ANALYTICS
We use cookies, and other technology, to store your preferences, record session information, and record user-specific information on which of our pages you access. We may also use third party cookies, such as those provided by Google, to help us refine our marketing and messaging through inline advertising. The information we collect is used to provide you with services, improve the content of our website, and may be used to contact consumers for marketing purposes. If you prefer not to make this information available, you can opt-out of our advertising features through settings in your browser or via Google’s opt out plugin found online. If you do not accept a cookie, it may impact the effectiveness of our website.
10. COMPLAINTS
If you have a complaint about MBF’s handling of your personal information, you can make a complaint in writing to us using the details provided in this Policy. We will need to verify your identity. We will respond to you within a reasonable period of time to acknowledge your complaint and inform you of the next steps we will take in dealing with your complaint.
If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) via the OAIC website, www.oaic.gov.au.
